Yogyakarta- Socialization of Intellectual Property Rights (HKI) in Indonesia so far has not been optimum. This has caused many people not understand the origin of Intellectual Property Rights, and even they are reluctant to register their inventions/works to Directorate General of Intellectual Property Rights of Ministry of Law and Human Rights.
Besides, there is the opinion that to register an intellectual invention/works needs much money. Moreover, the process is a long one to get certificate of intellectual property right. However, potential of works/ invention in Indonesia which their intellectual property rights can be registered is still very great. “In Indonesia, there are some people who assess that expense to register HKI is relatively expensive and takes long time, it can take up to 6-7 years. However, in Japan it takes only 1-2 years,” said lecturer of Faculty of Law UGM, Dina W. Kariodimedjo, S.H., L.L.M., in a discussion of Trade Issue at Center for World Trade Studies UGM, Friday (25/2).
In the discussion it was also shown a movie, Japan’s Steps Forward in Intellectual Property, and Wisdom is Key Element, which discuss about history and economic development in Japan and results of HKI system (property system).
The long process to make HKI certificate, according to Dina, is because officers/apparatus who work at Directorate of HKI work slowly. “The solution can be in the form of giving additional incentive or having them to join training which is held frequently,” said Dina who is also manager of International Undergraduate Program (IUP) of Faculty of Law, Cooperation and Development Section.
Unfortunately, impact of non-optimum socialization of HKI and indolence of apparatus in working is made worse by bad and unfair law enforcement. Dina explained that the emergence of piracy and counterfeiting cases are also examples of non-optimum use of HKI.
Meanwhile, the film showed that 5-7 percent of world trade goods which are circulating currently are counterfeited goods/products. Therefore, the loss caused by counterfeited goods/products circulation can reach around 400 billion dollars. The film also gave examples of several products, optical glass SUMITA, NIPPON Tansan Gas (NTG), and NIKURA measurement tools, starting from invention until patenting process.
Japan is a country with the highest number of patented inventions and potentially patented. For brand, Japan is the third position under the US, whereas for industrial design, this country is in the second place under China.
As it is known that generally HKI in Indonesia can be divided in two categories: Copyright and Industrial Property Right. Industrial Property Rights include patent, brand, industrial design, design of integrated circuit layout, trade secrets and plant varieties.
