Universitas Gadjah Mada (UGM) that has been sued by PT Neocelindo Intibeton Jakarta related to the non-performance charges incurring losses up to 94,7 billion rupiah in the construction of Gama Bookstore has won the appeal in a decision issued by the Supreme Court. Accroding to lawyer for UGM, Jeremias Lemek, S.H., at Stana Parahita Room on Wednesday (15/6), the verdict of the panel of judges led by Dr. Harifin A. Tumpa, S.H., M.H. in favour of his client was read out on 29 November 2010.
Following this verdict, in principle UGM did not commit fraud against PT Neocelindo Intibeton in relation with the management of the Gama Bookstore. UGM, however, still opens reconciliation with PT Neocelindo for the continuity of the management of Gama Bookstore. "To continue the construction of Gama Bookstore to be operational is surely not as nice as expected because there has been legal problems," he said.
Similar views were shared by Dr. Enny Nurbaningsih, S.H., M.Hum., Head of Legal Office of UGM. She said that the Supreme Court’s decision proved that UGM did not commit fraud as accused by PT Neocelindo Intibeton. The demand of PT Neocelindo was too huge and baseless. Besides, the land where Gama Bookstore is situated is state land while the construction has not been transferred to UGM. "The land is state land, therefore, the accussation proved untrue," she said.
With such verdict, the Supreme Court’s decision in favour of UGM has revoked the verdict issued by the Yogyakarta District Court No 10/Pdt/2010/PT.Y dated 16 February 2010 and the verdict by the Sleman District Court No 40/Pdt.G/2009/PN.Slmn dated 2 September 2009.
